Who can get a certificate

  • engage in cultural, scientific and educational activities;
  • implement international volunteer programs;

Which gives the presence of a temporary identity card to a foreigner

A temporary residence permit issued by a foreigner in time entitles :

  • register yourself as an entrepreneur (FOP);
  • get the same document from his family members;
  • get trained and get a driver’s license, etc.

Documents are also required to obtain a certificate

  • Passport of a foreigner or a document certificate, if it is a stateless person.
  • If the legal representative applies for the documents, he must include those identifying him and confirm the authority (the originals are immediately returned to the owner).
  • Ukrainian translation of the passport page of the person applying for the certificate.
  • Insurance policy.
  • Confirmation that the administrative fee has been paid.

Providing instructional assistance to units of the Armed Forces
  • Submission (petition) of the Ministry of Defense or other governing state body.
  • Petition of the commander of an Armed Forces unit or other military formations.
Stateless persons
  • Properly executed decision confirming the status of the person.
  • A receipt or other confirmation of payment of state duty.
  • The obligation of a person to obtain citizenship within 30 days and immediately notify the LCA.

The procedure for issuing a temporary residence permit

  • Prepare a package of documents.
  • Apply to the VHI or CNAP at the place of residence.
  • Write an application (fill in the questionnaire), attach it to the case and submit it for consideration.
  • In 15 working days.

Validity of the document

The certificate is usually valid for one year, but there may be exceptions – the term depends on the foreigner’s purpose for staying in Ukraine.

  • For those who came to get a job, the term is set, considering the period specified in the permit.
  • The person who will participate in the international project will have an opportunity to live with us while this project is being implemented.
  • The temporary certificate for foreigners who are the founders and beneficial owners of a legal entity remains valid for two years.
  • Students receive a certificate according to the term of study set by the relevant educational institution.
  • Military instructors who assist in the training of units of the Armed Forces receive a certificate valid for three years.

Reasons for exchange (renewal) of the certificate

The expiry certificate of temporary residence may be extended. Instead, the foreigner will receive a new one, if in advance, 15 days before the deadline, will prepare a complete package of documents and submit it in time for consideration in the territorial body of the LCA. A valid certificate must be presented with the documents, but only presented – it will be necessary to hand it in only after receiving a new one.

You can exchange the certificate for other reasons:

  • if the foreigner decides to change the surname, name or patronymic;
  • if the foreigner or the relevant services found discrepancies in the records, etc.

If such circumstances arise, you need to collect a case of documents within a month and contact the LCA for an exchange.

Refusal to issue a temporary certificate

LCA may refuse a foreign citizen and not issue a certificate if:

  • he already has another document – a permanent residence;
  • the person has already violated the terms of stay and does not want to comply with the decision on forced return, expulsion or even a ban on entry;
  • data from the card index and the register do not confirm the information provided by the foreigner;
  • the package of documents received by the LCA is incomplete or submitted in violation of deadlines;
  • the LCA received information from the SBU or the National Police about illegal or criminal actions of a foreigner;
  • the passport of a foreign citizen is damaged, spoiled, and contains signs of forgery or forgery.

Responsibility for violating migration legislation

A citizen of another state who comes to Ukraine to study or look for work as a tourist, businessman or preacher, and violates the conditions of staying on Ukrainian soil, is liable. Furthermore, a penalty (fine) is imposed for staying on our territory after the certificate’s expiration, an administrative violation.

In addition, foreign offenders can be returned to their country of origin or deported from Ukraine.

  • Forced return awaits foreigners whose actions violate the law or public order or threaten national security. The decision on forced return entails another restriction: a person will not have the right to enter Ukraine for three years.
  • Forced expulsion is applied to violators of sanctions already applied to them: they refuse to comply with the decision to return. In this case, the punishment is more severe, and the ban on entering Ukraine is longer than років5 years.

Administrative liability is provided by law for illegal crossing the state border or even attempting to cross it. A foreign violator who tried to cross the border without the authorities’ permission and relevant documents must pay a fine of 100 to 200 tax-free minimum incomes or be arrested for up to 15 days.

If there were several violators or a group of persons, the law provides a fine of 200 to 500 tax-free minimums.
