Foreign investors and entrepreneurs have reason to call Ukraine a country of opportunity. Convenient geographical location, tolerant attitude to non-residents, attractive housing prices, huge market and fertile land – are the five most important reasons that encourage foreigners to do business in our country and plan immigration. It is also important to be able to hire educated and responsible workers with a much lower salary than in Europe.

Despite some allegations of high levels of corruption, the country’s investment climate is improving, foreign companies’ profits are rising, and more and more people want to do business immigration to Ukraine. In addition, good legal support helps to minimize all existing risks.

Why Ukraine is chosen for a startup:

  • the flexibility of doing different types of business;
  • affordable cost of business start – at the beginning of the case, the registration of the company for foreigners will cost much less than in the EU, the amount;
  • the comfort of living – a multinational country with ancient culture and history hospitably receives representatives of all nations and becomes a great springboard for a successful business.

Features of Business Immigration

The term “business immigration” refers to foreigners’ unimpeded entry and stay in the country to create and conduct business. This reason for immigration creates the conditions for obtaining a residence permit for three years and its further extension if necessary. No less important is the fact that members of the immigrant’s family also receive the right not only to move but also to a temporary residence permit.

A temporary residence permit in Ukraine can be issued to a businessman in two cases:

Usually, foreign nationals choose the first option. When planning a business in our country, they first obtain a work permit and a temporary residence permit and only then start a business. This choice is understandable because not everyone can invest such a significant amount at once. Therefore, a foreigner registers a company with much less capital under the statute, becomes its head or chooses another position using an employment permit, and receives a certificate of three-year residence. For three years, he has had the opportunity to grow his business and prepare documents for immigration.

It is not easy to go this way without qualified legal support – the language barrier, ignorance of Ukrainian legislation, and bureaucratic complications will hinder it. Therefore, it is advisable and logical to entrust the management of experienced lawyers.

Opening a Legal Entity for Foreigners in Ukraine

The main step towards business immigration is to start your own company or open a legal entity for foreigners. The procedure is quite simple and transparent, almost no different from the usual registration, and has its nuances in the preparation of documents through the status of the founder – a citizen of another state. Therefore, a foreigner should first turn to lawyers:

  • sign a contract for legal services and provide all necessary information and documents for work;
  • to get acquainted with the draft Statute prepared by them, to approve it and other documents of the future enterprise;
  • together with representatives of the law firm to draw up a power of attorney from a notary for specialists and certify signatures.

Within one or two days from the transfer of all papers to lawyers, the company will be registered, and the foreigner will receive documents for opening a current account.

IMPORTANT! A foreigner becomes the company’s founder but cannot be its manager because he does not yet have an employment permit. Such permission can be obtained only if the company is registered and has a manager. Therefore, a Ukrainian with whom an agreement is concluded for a certain period and who will sign documents on behalf of a legal entity is temporarily appointed head.

It should be emphasized that the basis for legalizing a stay in Ukraine and obtaining a temporary residence permit is a work permit, not starting a business. That is, a temporary certificate is issued based on employment. For this:

  • the newly formed company submits an application for a work permit to its founder;
  • after obtaining a permit, a foreigner changes the head of the company.

Each stage is accompanied by paperwork and can be complicated by a lack of competence. That is why it is important to turn to law firms with a good reputation and considerable experience in migration matters. One such company is Status Ko, which has been providing business immigration services for many years, knows all the bureaucratic nuances and is guaranteed to carry out the procedure in a short time.

The Main Stages of the Project

  • Execution of a contract with a law firm to provide services and coordinate project details.
  • Execution of a power of attorney to represent the interests of a foreigner in government.
  • Registration of a legal entity. Registration of the company for foreigners and citizens of Ukraine takes place in the presence of a notarized Charter and other constituent documents.
  • Issuance of an employment permit for the owner of the enterprise. Permission to use the work of a foreigner is issued for 3 years. The package of documents contains the application, the passport for presentation and its notarized copy in the Ukrainian language, the photo 3,5х4,5 cm, and the copy of the employment contract certified by the employer. The application review period is 7 working days.
  • Obtaining a type D A D-04 visa is granted to citizens of other countries for employment. A business immigrant uses the visa’s validity period to obtain a temporary or permanent residence certificate. For example, a temporary certificate in Ukraine begins to be issued by a foreigner at least 15 days before the visa’s expiration.
  • Issuance of a temporary residence permit for 3 years. In addition to the passport of a foreign citizen and its notarized translation into Ukrainian, the package of documents contains an insurance policy and the charter of a company founded by a foreigner. Term of registration – up to 15 working days.
  • Registration of TIN for a foreigner. To obtain a tax number for a foreigner, you need to apply to the local traffic police department with a package of documents – an application, passport and a copy with a Ukrainian translation, and a certificate of temporary or permanent residence.
  • Registration of residence address. The procedure involves entering information into the Unified Demographic Register with the address for correspondence and delivery of correspondence. There is only one address, even if someone lives in several places. Registration data are included in the residence permit – both temporary and permanent.

IMPORTANT! For most stages – preparation of constituent documents, company registration and management change, notarization of documents, obtaining a work permit, and direct participation of a foreigner is not required. All cases can be completed without his physical presence. But subject to the proper issuance of a power of attorney with the right to sign representatives in Ukraine. Usually, such a power of attorney is issued at the consulate.

What next? Suppose three years have passed and business immigration has not been completed. In that case, the stay in Ukraine can be extended by obtaining a new employment permit at the request of the company or company and a temporary residence permit for 3 years. If the company does not work, you do not need to pay taxes. Only report annually to the tax service.

But if the goal of a foreigner is not only to stay in our country but also the development of business, then the key to its successful operation without the risk of running into pitfalls will be just the right start. And it starts with choosing a reliable partner, and the sooner you decide on the choice, the closer the success and better prospects.
