About the statement of the Procedure for calculation of term of temporary stay in Ukraine of foreigners who are citizens of the states with a visa-free order of entry

According to sub-item 2 of item 2 of the Procedure for extension of stay and extension or reduction of temporary stay of foreigners and stateless persons on the territory of Ukraine, approved by the resolution of the Cabinet of Ministers of Ukraine of February 15, 2012 № 150, ORDER:

  1. To approve the Procedure for calculating the term of temporary stay in Ukraine of foreigners who are citizens of the states with visa-free entry procedure, which is attached.
  2. The Department of Legal Support of the Ministry of Internal Affairs (DV Gorbas) to ensure the submission of this order for state registration to the Ministry of Justice of Ukraine in the prescribed manner.
  3. This order becomes effective from the date of its official publication.
  4. I reserve the right to control the execution of this order.

ORDER
calculation of the period of temporary stay in Ukraine of foreigners who are citizens of countries with visa-free entry

  1. Citizens of countries with visa-free entry may temporarily stay on the territory of Ukraine for no more than 90 days for 180 days, unless otherwise specified by international treaties of Ukraine.
  2. Officials of the State Border Guard Service of Ukraine (hereinafter referred to as the State Border Guard Service) and the State Migration Service of Ukraine (hereinafter referred to as the State Migration Service) within the powers defined by the legislation of Ukraine.
  3. When a foreigner enters the territory of Ukraine, the calculation of the period of stay allowed to him shall be carried out by an official of the State Border Guard Service at a checkpoint (control point) across the state border of Ukraine by deducting 180 days from the date of actual entry. A foreigner has not violated this term if he has been on the territory of Ukraine for no more than 90 days within this 180-day period.

If a foreigner is found to have exceeded the period of stay allowed during border control, a decision is made to refuse to cross the state border of Ukraine to enter Ukraine in accordance with the first part of Article 14 of the Law of Ukraine "On Border Control".

  1. During the stay on the territory of Ukraine, the calculation of the period of stay allowed to a foreigner is carried out by LCA officials by deducting 180 days back from the day of control (the day on which it is necessary to determine the legality of the foreigner's stay on the territory of Ukraine). A foreigner has not violated this term if he has been on the territory of Ukraine for no more than 90 days within this 180-day period.

If a foreigner is found to have exceeded the period of stay allowed in Ukraine, the LCA official acts in accordance with the Instruction on Registration of Materials on Administrative Offenses by the State Migration Service of Ukraine, approved by the Ministry of Internal Affairs Order No. 825 of August 28, 2013. for № 1654/24186.

  1. When a foreigner leaves the territory of Ukraine, an official of the State Border Guard Service shall check whether he has not exceeded the period of stay on the territory of Ukraine by deducting 180 days from the date of actual departure. A foreigner has not violated this term if he has been on the territory of Ukraine for no more than 90 days within this 180-day period.

If a foreigner is found to have exceeded the period of stay allowed on the territory of Ukraine, an official of the State Border Guard Service acts in accordance with the Instruction on registration of administrative offenses by officials of the State Border Guard Service of Ukraine, approved by the Ministry of Internal Affairs Order No. October 2013 for № 1729/24261.

  1. The actions of the officials of the State Migration Service and the State Border Guard Service, determined by this Procedure, may be appealed to the relevant higher level body or to the court in the manner prescribed by law.
