According to subsection 2 paragraph 2 of the Procedure for extending the period of stay and extension or reduction of the brief term stay foreigners and stateless persons in the territory of Ukraine, approved by resolution Cabinet Ministers of Ukraine dated February 15, 2012 No. 150, I ORDER:

1. Approve The Procedure for calculating the temporary term stay in Ukraine for foreigners who are citizens of states with a visa-free entry procedure that is added

Legal department provision of the Ministry of Internal Affairs ( Gorbals D.V.) to present this order to the state registration with the Ministry of Justice of Ukraine in the established order.

PROCEDURE

for calculating the temporary term stay in Ukraine, foreigners who are citizens of countries with visa-free entry

1. Citizens of countries with visa-free entry can temporarily help to be on the territory of Ukraine for no more than 90 days within 180 days if no other term is specified international treaties of Ukraine.

2. Calculation allowed to a foreigner who is a citizen country with visa-free entry procedure (from now on - foreigner ), the period of stay in the territory of Ukraine carry out officials of the State border services of Ukraine (from now on - the State Border Guard Service ), and the State migration services of Ukraine ( further - LMS) within the limits of the powers specified legislation of Ukraine.

3. During entry, _ foreigner to the territory of Ukraine calculation allowed his term of stay carries out an official of the State Border Service at the checkpoint ( control point ) across the state border of Ukraine by deduction from the day of actual entry 180 days ago. The foreigner has not violated the specified term if, within these 180 days, he was on the territory of Ukraine for no more than 90 days.

In case during implementation _ there was border control discovered excess a foreigner allowed his period of stay is accepted the refusal decision to cross the state border of Ukraine to enter Ukraine by the established procedure part of the first Article 14 of the Law of Ukraine "On Border Control."

4. While staying on the territory of Ukraine, calculation allowed period of stay for a foreigner carried out by officials of the Ministry of Internal Affairs by deducting 180 days back from the day of control (the day on which necessary to determine the legality of stay a foreigner on the territory of Ukraine ). The foreigner has not violated the specified term if, within these 180 days, he was on the part of Ukraine for no more than 90 days.

In case of detection excess, a foreigner allowed his term of stay in the territory of Ukraine; the civil service official acts by the Registration Instructions materials about administrative offense by the State Migration Service of Ukraine, approved by order of the Ministry of Internal Affairs of August 28, 2013 No. 825, registered in the Ministry of Justice of Ukraine on September 25, 2013, under No. 1654/24186.

5. During the departure _ of a foreigner from Ukraine, an official of the State Border Service checks did not exceed the period of stay in the region of Ukraine by deduction from the date of actual departure 180 days ago. The foreigner did not violate the specified term if, within these 180 days, he was on the territory of Ukraine for no more than 90 days.

In case of detection excess, a foreigner allowed his term of stay in the territory of Ukraine an official of the State Border Service works by the Registration Instructions officials of the State border services of Ukraine materials of administrative cases offense approved by order of the Ministry of Internal Affairs of September 18, 2013 No. 898, registered in the Ministry of Justice of Ukraine on October 9, 2013, under No. 1729/24261.

6. Actions of officials of the State Internal Revenue Service and the State Border Service, identified by this Procedure, may be appealed to the relevant higher body equal or the court in the established legislation of order.
