"How long will it take me to extend my permanent residence permit? I don't want problems at the border or with the police."
And this is an excellent question.
Although a permanent residence permit in Ukraine usually has no expiration date, it still needs to be extended or replaced in some instances, such as changing the document, reaching a certain age, wear and tear, or a change of surname or appearance. Sometimes, a foreigner finds out about this only when it is too late, and in such a situation, the consequences can be severe: cancellation of the residence permit, a fine, or even a ban on entry.

2. What is a permanent residence permit, and when does it need to be renewed
Many people mistakenly believe that a permanent residence permit is a document that never needs to be renewed. This is partly true: a permanent residence permit in Ukraineis valid for an unlimited period. However, what is not considered is that the plastic document, which confirms the right to permanent residence, is sometimes subject to replacement. This replacement is often referred to as an "extension."
As a rule, the question arises in the following situations:
You have reached the age of 25 or 45 - these are the age limits after which Ukrainian documents and residence permits are subject to exchange.
Your ID card is damaged or worn out—for example, the chip is cracked, or personal data has been erased.
You have changed your surname or name - say, after marriage.
Your appearance has changed so much that the photo no longer matches your real appearance - for example, after surgery or a significant change in style.
You have received a new passport, especially if the old one was the main document when you first applied for a residence permit.
Our clients are often surprised when they learn that they need to exchange a document. One recent example is a Turkish citizen living in Ukraine for over 6 years, and his permanent residence permit was in the old format (a laminated card dating back to 2011). 3. How long does it take to prepare documents
My legal practice shows that foreigners often underestimate how long it takes to prepare for submission to the SMS. Sometimes everything is simple: gather the documents, go, and submit. But in reality, everything is a little more complicated.
To apply for a permanent residence permit, you need to collect a complete package of documents, which is
translations of documents if they are issued in a foreign language (with notarisation);
If necessary, documents confirming a change of name, age, or loss of a document.
❗ At this stage, most people spend 3 to 7 business days, especially if it's necessary:
Take out insurance (not all insurance companies provide the correct type of policy for VHI);
Obtain registration of the place of residence - in Ukraine, a document will not be accepted without registration.
Reissue the TIN if the full name or identification document has been changed.
To make a high-quality translation of documents (preferably with notarisation, which takes an additional 1-2 days).
One of our clients from Israel decided to collect everything on his own. He spent two weeks getting the registration and then waited for the translation. When he came to us, it turned out that one of the documents had already expired, and he had to start all over again.

4. How long does it take to process documents at the SMS?
When all the documents are collected, the next step is to submit them to the territorial unit of the State Migration Service (SMS). Many people breathe a sigh of relief at this stage, but the least predictable part begins now - the waiting.
Unfortunately, the deadlines in Kyiv and the regions often do not coincide with the official ones. Over the past 12 months, we have received the following results:
Kyiv (Main Department): In 60% of cases, a residence permit is issued in 15-20 working days, sometimes longer.
Lviv was relatively stable; we met the deadline of 15 days.
Kharkiv, Dnipro - delays of up to 3-4 weeks.
Odesa has a record delay: 27 working days in the case of our client, and that was after a second application.
📌 One recent case: a Georgian citizen submitted documents through the ASC in Kyiv on 2 April. According to the official receipt, the date of readiness was 19 April. But when we came to pick up the residence permit, it was not yet ready. It was only after a lawyer's request that the situation was resolved, and we received the certificate on 24 April. This is still a good result.
🔹 What determines delays?
The SMS unit's workload is higher in spring and autumn and slightly better in summer.
Shortages of ID forms still happen, albeit rarely.
Failure to transfer data to the centralised system - if verification fails, the process freezes.
Human factor - from experience, a lot depends on the specialist who accepts the documents.
💡 Tip: Be sure to keep a copy of the receipt with the date of receipt of documents - it will serve as your proof in case of delay. If the promised deadlines have passed, you can file a written complaint or contact us - we respond promptly through lawyer requests.

5. When are delays possible?
Even if you carefully prepare the documents and submit them to the SMS within the specified timeframe, this does not guarantee that everything will go according to plan. In practice, I have seen dozens of situations where the residence permit process was delayed due to seemingly trivial issues. The result is lost time, nerves, and the risk of being outlawed.
Here are the most common reasons for delays:
Errors or inconsistencies in documents
One of the most common pitfalls. It often occurs when:
The surname is incorrectly transliterated in the translation.
The data in the insurance policy does not match the passport.
The document is submitted without a notarised translation.
No details of the registration of the place of residence.
📍 Case study: An Indian citizen contacted us after he had been denied an exchange of his residence permit twice. The data in his passport translated his surname as "Kumar" instead of "Kumaar." The SMS does not forgive such a "trifle."
Lack of up-to-date registration of the place of residence (registration)
Documents will not be accepted without a registered address in Ukraine. A foreigner has often moved, and the records contain an old address no longer relevant. Even if you live at the new address, it is considered a violation until it is officially registered.
Technical failures or changes in the SMS regulations
Sometimes, the SMS delays processing due to malfunctions in the central database or a "transition period"—for example, updating forms or introducing new documents or instructions. This happened in 2022, when the requirements for photographs changed, and some packages were sent back for processing.
Human factor
The influence of the human factor should not be underestimated. One SMS employee can check a package of documents in 10 minutes, while another will find a minor formality and ask to redo everything. There are also situations when the package is lying "on the table" and they have forgotten about it - such cases have happened more than once.
📌 Our advice: To avoid delays, we always do a preliminary audit of the package of documents before the client goes to the SMS. This allows us to identify weaknesses that may cause a refusal or delay. If necessary, we submit documents through a representative who controls the situation at every stage.

6. What to do if the term has expired and you have not had time to extend it
Sometimes, circumstances arise that a foreigner does not have time to submit documents to exchange a residence permit on time. A business trip, illness, a trip home, a misunderstanding with an interpreter, or registration is life. But what should you do if you suddenly discover that the deadline has passed?
📌 First of all, do not panic. The law provides that a permanent residence permit does not automatically lose its validity because time has passed since it was issued. However, violating the migration regime without a valid document is grounds for administrative punishment.
What is the real threat in case of delay?
Penalty: According to Article 203 of the Code of Administrative Offences, foreigners residing in Ukraine without a valid document are subject to a fine of UAH 1,700 to UAH 5,100.
Problems when leaving Ukraine: Border guards can stop you, investigate the circumstances, and record violations, which can affect your subsequent entries.
Possibility of residence permit revocation in case of long-term violation or gross violations of the stay rules.
Refusal of the following exchange or a new residence permit, especially if the situation was not a one-off.
Can I renew a residence permit after its expiry date?
Yes, you can. But it all depends on the time that has passed:
If a few days or a week have passed, in most cases, the residence permit will be exchanged after paying a fine and submitting an explanation.
If it is over a month, the SMS may require additional documents, confirmation of the circumstances, or even the initiation of the cancellation procedure.
If you left Ukraine without a valid document, you may have difficulties re-entering the country; sometimes, you must start the procedure from scratch.
Case study: Our client, a Nigerian citizen, could not exchange his residence permit in time due to a long illness. More than 3 weeks had passed since the old document had expired. We prepared a medical certificate and a cover letter for him and accompanied him to the SMS. The result was a fine of UAH 1,700 and the successful issuance of a new residence permit within 18 working days.

7. What practice advises: advice from a lawyer
Over the years of working with foreigners, I have come to one important conclusion: there is no such thing as "in time" in migration matters. There is only one time, or late. I want to share some tips to save you time, nerves, and legal stress.
Start the procedure at least 30 days before you need to exchange
Even if you are unsure whether you need to renew your residence permit, seek advice. The documents often look fine, but it turns out that the photo no longer matches your appearance, or you will soon reach the age when the document must be replaced.
Please start preparing at least four weeks before the desired date. This gives you time without stress for insurance, registration, certificates, and translations.
Check the package of documents not on your own, but with a lawyer
Our company conducts a complimentary initial check of the papers in the package. In 8 out of 10 clients, we find inaccuracies that could cause a refusal or delay: an incorrect date in the translation, an incorrect insurance code, an error in the address registration, etc.
Keep all receipts and copies.
Every document you submit should be scanned and saved. A receipt for document submission, case number, and date of application may be required if the process is delayed or if you need to apply to the SMS with an application or complaint.
Do not ignore the news from the SMS.
Migration legislation is constantly changing. For example, in 2023, the requirements for the form of photographs and some insurance policies were updated. 8. Frequently asked questions from clients

Is it possible to submit documents online?
Unfortunately, at the time of writing, the SMS of Ukraine does not provide for a full-fledged online submission of documents to exchange a residence permit. You can sign up for an electronic queue through the SMS website or the Diia portal, but the procedure must be completed in person or through an authorised representative.
Do I need to be physically present in Ukraine to extend my residence permit?
Yes. You cannot extend your residence permit remotely if you are abroad; you can only do so if you are physically present in Ukraine.
Is it necessary to have a residence registration?
Yes, submitting documents without a residence permit (registration certificate) in Ukraine is impossible. If you don't have one, you must register your place of residencebeforehand. We help clients with this procedure separately, considering all the SMS requirements.
Can I apply in another region?
No. The exchange of a permanent residence permit takes place at the place of your registration. If you reside there, you should contact the Kyiv division of the SMS. If you are registered, for example, in Cherkasy, you should go through the procedure there.
Can I be refused a residence permit exchange?
Yes, in such cases:
An incomplete or invalid package of documents has been submitted.
The terms of stay or registration have been violated.
Falsified documents were found.
There are grounds for revoking the residence permit (for example, a court decision or a decision of the SMS).
In such situations, we offer representation in an administrative appeal or full legal support for a resubmission.
Can an old ID card be changed to a new biometric one?
Yes, and it is even recommended. Ukraine is gradually switching to electronic documents with a contactless chip, so old paper or laminated IDs must be updated. The procedure is the same as when you exchange a residence permit.
