Some question declaration and registration places accommodation and management registers territorial communities

According to part the second Article 4, part the first of articles 9 and 11, parts at eight Article 18, parts five and seven Article 21, part the second Article 22, parts fourth and sixth Article 24 et seq third and seventh Article 26 of the Law of Ukraine "On Provision public ( electronic public ) services of declaration and registration places residence in Ukraine ” Cabinet Ministers of Ukraine decrees :

1. Approve such that _ are added :

Declaration and registration procedure places residence ( stay ) ;

The order of creation, management, and administration registers territorial communities ;

Order of electronic informative interaction between information and communication systems and transmission by registration authorities information to the Unified State Demographic registry.

2. PROCEDURE for
declaration and registration places residence ( stay )

1. This Order defines mechanism implementation declaration/registration places accommodation ( stay ), changes places accommodation, withdrawal from declared/registered places accommodation ( stay ), cancellation declaration/registration places residence ( stay ), as well as establishes forms necessary for these documents.

2. Terms in this Order are used in the meaning given in the Laws of Ukraine "About providing public ( electronic public ) services of declaration and registration places residence in Ukraine ”, “About freedom of movement and free choice places residence in Ukraine ”, “About electronic communications ", "On protection of information in information and communication systems", "About electronic trustworthy services ", "About the One state demographic register and documents that _ confirm the citizenship of Ukraine, prove identity or her special status", "On the legal status of foreigners and stateless persons ", " On refugees and persons who in need additional or temporary protection ", "About administrative services " and "About local self -government in Ukraine ".

3. Declaration/registration places accommodation ( stay ), withdrawal from declared/registered places accommodation ( stay ), change places accommodation ( stay ), cancellation declaration/registration places residence ( stay ) of a person is carried out by the registration authority, on the territory territorial community to which they apply powers the relevant council.

4. A person can declare/register their own place of residence ( stay ) for only one address _ In the case when a person lives in two or more places, it carries out declaration/registration places residence ( stay ) at one of these addresses at your own by choice At the address declared/registered places residence ( stay ) with the person is conducted official correspondence and service official correspondence.

For the period of temporary occupied territories in Donetsk and Luhansk regions, Autonomous Republic Crimea, and the city of Sevastopol part of the first Article 4 of the Law of Ukraine "On Provision public ( electronic public ) services of declaration and registration places residence in Ukraine " ( hereinafter - the Law) does not apply to persons, places residence whose registered in housing that _ temporarily located _ occupied territories in Donetsk and Luhansk regions, Autonomous Republic Crimea and the city of Sevastopol. Such a person can declare/register to place his own accommodation without deregistration _ _ places his own previous residence _

Person, place residence which registered in housing that _ temporarily located _ occupied territories in Donetsk and Luhansk regions, Autonomous Republic Crimea and the city of Sevastopol, maybe declare/register place his own living abroad temporarily occupied territory of Ukraine without introducing any a note on a citizen's passport of Ukraine, produced in the form of a booklet.

Information about the registered place residence of such a person in the dwelling that temporarily located _ occupied territories in Donetsk and Luhansk regions, Autonomous Republic Crimea, and the city of Sevastopol, are entered into the register territorial of the community that carried out appropriate registration acting outside temporarily occupied territory of Ukraine.

5. Citizen of Ukraine, which lives on the territory of Ukraine, as well as a foreigner or a stateless person who is legal grounds constantly or temporarily live on the territory of Ukraine, obliged within 30 calendar days after withdrawal from declared/registered places accommodation and arrival at a new place residence ( stay ) to declare/register his _ Foreigner or a person without citizenship, which received a certificate of application for protection in Ukraine, they can register place his own stay in Ukraine.

Parents or other legal representatives are obliged to declare/register the place of residence ( stay ) of the newborn child for three months from the state day registration of her birth _

In case of a person, a place residence which declared/registered, declares or registers new place living with a cohabitant removal from the previous one places residence ( stay ), application for withdrawal from declared/registered places accommodation is not provided. At the same time, introduction changes to the registered territorial community according to the previous one place residence is carried out on the basis of notification of the registration authority about withdrawal from declared/registered places residence ( stay ) of a person from indication give removal from place residence ( Appendix 1 ).

6. Issued competent authorities of foreign country state documents that _ submitted for registration places accommodation, withdrawal from declared/registered places residence testify in the established by the legislation of the order if nothing else is provided international treaties of Ukraine. Such documents are submitted with a translation into the Ukrainian language, certified notarized.

7. Declaration places residence of the person according to the declaration of place residence ( further - the declaration ), submitted by such a person in the electronic form means A single state web portal electronic services ( hereinafter - Action Portal ), is carried out in relation to a person who:

1) passed authentication using _ integrated systems authentication, qualified electronic signature, or other means of electronic identification, which give it possible to unambiguously establish the identity of the applicant ;

2) declares the place of residence :

in housing private forms property, provided introduction information about this housing to the State Register real estate rights property ;

in a dormitory that does not belong to the person on the right property, common property ( joint partial or joint compatible property ), provided granting the consent of the authorized person for the management ( maintenance ) of the dormitory, which belongs to the field management enterprises, institutions, organizations regardless from forms property ( hereinafter referred to as the authorized person of housing ).

8. Declaration is formed by means of the Action Portal in an arbitrary manner in a form suitable for the perception of her content, in accordance with the information specified in clause 9 of this Procedure.

9. In the declaration are noted such personal information :

1) surname, proper name, patronymic (if available );

2) gender;

3) date of birth ;

4) place birth ( country, region, district, settlement (if available );

5) information about citizenship ;

6) the address of the dwelling in which is declared place of residence ;

7) previous place residence ( stay ) with indication addresses housing ( if previous place residence ( stay ) of the person is declared/registered);

8) contact data (phone number, email address mail, others means the communication (if available );

9) requisites of a person's passport document ( series and/ or number, date of issuance of a citizen's passport of Ukraine, name authorized subject that _ issued, validity period ( if available ); for a child under the age of 14, except foreigners and stateless persons, - birth certificate series and number or details of the registration document of birth, issued by a competent body of a foreign country state and legalized in the prescribed manner, if nothing else is provided international agreement of Ukraine, consent to binding whose provided by the Verkhovna Rada of Ukraine, provided confirmation of such information means electronic informative interaction ;

10) details of a foreigner's passport document or stateless persons (if available ) - for persons who declare place his own residence on the basis permanent permits _ residence or temporary permits _ accommodation, arranged means The only state demographic registry ;

11) unique record number in the Unified State Demographic Register registers (if available );

12) registration number of the account cards payer taxes ( if any );

13) a separate record number in the Unified State Register conscripts, conscripts, and reservists ( further - Register conscripts ) (if available ) or data military registration document (type of military registration document, name of the district ( united district), city (district in cities, united city ) territorial center of procurement and social support ( further - the territorial center of recruitment and social of support ) in which the person is and/ or was on military duty accounting; for conscripts and reservists - also series and/ or number of the military registration document (if available );

14) surname, proper name, patronymic (if available ), contact details data (phone number, email address mail, others means the communication (if available ) of parents or others legal representatives or one of them, at the address which ( which ) is carried out declaration places residence child ;

15) surname, proper name, patronymic (if available ), contact details data (phone number, email address mail, other means of contact (if available ), and job title of the housing authority who provided consent to declaration places residence of a person in established cases legislation ;

16 ) payment information administrative collection ;

17) date of formation declarations.

Responsibility for the completeness and authenticity of the information specified in the declaration is borne by the person who she serves _

10. If the person is not the owner ( co-owner ) of the house, at the address whose is declared place her residence and information about which are entered in the State Register real estate rights property, in the declaration of place residents in addition to the information provided for in clause 9 of this Procedure, are indicated information about the owner ( co-owners ) of the home separately in relation to each owner ( co-owner ) of housing, namely :

1) surname, proper name, patronymic (if available );

2) date of birth ;

3) details of the person's passport document ( series and/ or number, date of issue, name authorized subject that _ issued, validity period ( if available ) of the citizen's passport of Ukraine or passport document of a foreigner or stateless persons );

4) registration number of the account cards payer taxes according to the State register physical paying persons _ taxes ;

5 ) information about documents that confirm ownership of the object real estate ( name, number, and date of the document that confirms ownership ) ;

6) contact data (phone number, email address mail, others means connection (if available ).

11. In case the person is not the owner ( co-owner ) of housing, at the address whose is declared place her residence, declaration places residence of a person is carried out by consent owner ( co-owners ) of housing, authorized person of housing, which is confirmed electronic signed that _ based on qualified certificates electronic signature and is displayed in the declaration during her _ formation _ Consent the owner ( co-owners ) of housing is not required in this case declaration places residence children under the age of 18 at the address declared/registered places residence their parents or others legal representatives or one of them.

12. Payment administrative collection is carried out with the help of means of the Diya Portal during the formation _ declaration before her presentation _ At the same time, the document that confirms payment administrative the fee is not attached to the declaration.

13. Adults declare _ place his own residence independently _

14. A child by age from 14 years old independently declares place his own residence as declared/registered place residence parents or others legal representatives or one of them without their consent _

15. A child by age from 14 years old independently declares place his own residence at the address another housing than _ declared/registered place residence her parents or others legal representatives, by agreement parents or others legal representatives or one of them. In case declaration places accommodation in a dormitory for a period of acquisition education that consent is not given.

16. Place residence child under 14 years of age can be declared at the address places residence of one of the parents or others legal representatives, in particular simultaneously from removal from the previous one declared/registered places residence, according to the declaration submitted by one of her parents or others legal representatives by agreement the other parent or legal representatives child _

17. Consent the other parent or legal representatives child is confirmed electronic signed that _ based on qualified certificates electronic signature _

In case failure to provide one of parents' consent according to requirements registration of this item places residence of a child who has not reached the age of 14 is carried out in accordance with clause 33 of this Order.

18. In the event that the place residence parents or other legal representatives child declared/registered under one address, consent from the other parent or legal representatives is not provided.

19. In case declaration places accommodation, including with simultaneous removal from the previous one declared/registered places residence ( stay ), by parents or one of them together with a child ( children ) under the age of 14, for each of them are formed separate declarations within 24 hours which are sent to the registration body.

20. Declaration can be submitted on the initiative of the owner housing or of the authorized person of housing under the condition providing in electronic form by means of the Diya Portal consent person, place residence which declared therein _ housing _ In such a case declaration served in accordance with the specified information in points 9 and 10 of this Order. Consent of person, place residence which declared, confirmed electronic signed that _ based on qualified certificates electronic signature _

21. The person who is the acquirer of education and lives in a dormitory that belongs to the field the management of the educational institution declares own place accommodation in such a dormitory in the order specified points 9 and 10 of this Order.

During submission _ place declarations _ living in a dormitory of an educational institution consent authorized person of housing is certified her electronic signed that _ based on qualified certificates electronic signature _

22. Declaration can be formed, in particular with the use of mobile application of the Action Portal, in the order specified points 9 and 10 of this Order, by a person who has a citizen's passport of Ukraine in uniform cards and/ or citizen's passport of Ukraine for going abroad, or permanent permit _ residence, or temporary permit _ accommodation, arranged means The only state demographic register, installed mobile application of the Action Portal on an electronic device, criteria whose support use of such an application, and passed electronic identification and authentication.

23. During formation _ declarations are received/confirmed such information :

1) from the State Register Acts civil status of citizens - information about the series and number, date of issue birth certificate, name of the body which him published, and about parents or one of the parents, if statement serves a minor ;

2) from the State Register real estate rights property - information on ownership of housing, encumbrances property rights to housing ;

3) from dictionaries of the State Register real estate rights property - information about actual name populated points named _ objects, streets, alleys, squares, boulevards, avenues, thoroughfares, etc. of each settlement and name streets named objects ;

4) from the Unified State Demographic registry through a single information system of the Ministry of Internal Affairs ( regarding persons who _ have citizen's passport of Ukraine in uniform cards and/ or citizen's passport of Ukraine for going abroad, or permanent permit _ residence, or temporary permit _ accommodation, arranged means The only state demographic register ) - information about the unique number of the record in the indicated Registers, gender of the person, date and place date of birth, passport document of the person, address and date of the current declared/registered places residence or the address and date of the previous one declared/registered places residence and the date of removal from it (for persons who on the date of formation they do not have a declaration declared/registered places residence );

5) from the Register conscripts - a separate record number in the specified Registers (if available );

6) from the department informative DMS system through a single information system of the Ministry of Internal Affairs - information about the address and date of the current declared/registered places residence or the address and date of the previous one declared/registered places residence and the date of removal from it (for persons who on the date of formation they do not have declarations (statements). declared/registered places residence ), personal information (if available ) (gender, date and place date of birth, series, and number, date of issuance of the citizen's passport of Ukraine, name authorized subject that _ published ).

24. Formation declarations cease by means of the Diya Portal if specified in its information :

provided in full volumes ;

do not answer requirements arithmetic and format-logical control;

do not answer information received _ by means of the Diya Portal from information and communication systems specified in clause 23 of this Procedure.

After the formation of declarations software by means of the Action and Overlay Portal electronic signature that _ is based on qualified certificates electronic signature, the declaration is locked for editing and sent through a single information system of the Ministry of Internal Affairs to the registration body.

25. Registration authority on the day of receipt declarations or the next working day in the case when the declaration arrived during non-working hours, carries out declaration places residence of a person or accepts decision on refusal to declare places residence ( further - the decision on a refusal ) in the established legislation of order.

26. On the day of declaration/withdrawal from declared/registered places of residence or adoption decision on the refusal by the registration authority sends through a single information system of the Ministry of Internal Affairs:

Diya Portal - information on declaration/withdrawal from declared/registered places of residence or refusal decisions, which _ are sent by the Action Portal to the email address mail the applicant, as well as to his personal electronic office user on the Portal Action (in case of formation office ) or mobile _ action Portal application ;

2) to the Register conscripts - information on declaration/withdrawal from declared/registered places residence conscripts, conscripts, and reservists.

Data contain surname, actually, name, patronymic (if available ), registration number of the account cards payer taxes (if available ), a unique record number in the Unified State Demographic Register register (if available ), a separate entry number in the Register conscripts or data military registration document in accordance with subsection 13 paragraph 9 of this Procedure, removed place residence and/ or new declared place accommodation (if available ).

3) to the register territorial community according to the previous one place residence - notice of withdrawal from declared/registered places residence of the person (on the form in accordance with Appendix 1 ) in the case declaration places living with a cohabitant removal from the previous one places residence _ In the case when the register territorial community is being conducted means own information and communication systems of the registration authority and notification of withdrawal from declared/registered places residence of a person is impossible to send the in electronic form, such notification on the day of the event registration actions is sent to the relevant registration body in paper form;

4) to the department informative DMS system for further transfers to the Unified State Demographic register - information about the declared place residence or withdrawal from declared/registered places accommodation according to the list data specified in the Electronic Order informative interaction between information and communication systems and transmission by registration authorities information to the Unified State Demographic register, approved by resolution Cabinet Ministers of Ukraine dated February 7, 2022 No. 265.

27. Registration places residence ( stay ) of a person is carried out during personal _ visiting the registration body ( including through the grant center administrative services ) at the address housing regardless from forms property _

28. In case the person can not independently contact the registration authority, registration places residence ( stay ) can be carried out at the request of a legal representative or representative on the basic power of attorney certified in accordance with the procedure established by law ( hereinafter - the representative ).

29. Registration places residence ( stay ) of a person is carried out on the day of receipt by the registration body documents.

30. In case of registration places residence is carried out simultaneously from removal from the previous one places accommodation ( stay ), a separate application for withdrawal from declared/registered places accommodation is not provided.

31. Persons who have reached the age of 14, independently served an application for registration places residence ( stay ).

32. In case submission of an application for registration places residence ( stay ) by a person who has not reached the age of 18, registration places accommodation ( stay ) is carried out by agreement parents or other legal representatives such a person Consent is not granted if the person is the acquirer education and carries out registration his own places residence ( stay ) in a dormitory, which belongs to the field management of the educational institution.

33. Submission of an application for registration places residence ( stay ) of a person under the age of 14 carried out by one of her parents or other legal representatives by agreement the other parent or legal representatives ( except cases when place residence child defined appropriately by a court decision or by the decision of the guardianship authority ).

Consent from parents or other legal representatives may be given in the presence of the recipient's application for registration places residence or certified notarized in the established legislation of order.

34. In the event that the place residence parents or other legal representatives of persons under the age of 18 are declared/registered under one address, consent of the other parent or legal representatives is not provided.

35. For registration places residence ( stay ) person or her legitimate representative ( representative ), authorized person of housing or authorized person of specialized social institution, an institution for the homeless persons, another provider social accommodation services _ submits :

1) application in the form according to Annexes 2, 3, and 8 ;

2) passport document of a person or certificate of application for protection in Ukraine ( for persons who register place stay );

3) birth certificate ( for children under the age of 14 ), except for foreigners and stateless persons, or a registration document of birth, issued to the competent body of the foreign state and legalized in the prescribed manner, if nothing else is provided international agreement of Ukraine, consent to binding whose provided by the Verkhovna Rada of Ukraine ;

4) certificate of registration of a person as a citizen of Ukraine (in the case implementation for the first time registration places residence child under the age of 14, in the birth certificate which it is stated that the parents or one of the parents is a foreigner or a stateless person );

5 ) documents that confirm :

the right to stay ( stay ) in housing, in particular, certificate of ownership, warrant, contract lease (hire, sublease ), a contract for renting housing in a dormitory (for students ), a court decision that has gained legal force forces, about providing a person has the right to move into residential building premises, recognition of the right of use by a person residential premises or ownership rights to it, registration rights places residence or others confirming documents. In case of absence of specified documents registration places residence ( stay ) of a person is carried out by consent owner ( co-owners ) of housing, lessee and members of the family, authorized person of housing ( indicated documents and consent are not required during registration _ places residence ( stay ) of minors and minors children at the address declared/registered places residence ( stay ) of parents or legal representatives ( representatives ), or one of them;

the right to stay or register in a specialized _ social institution, another provider of social services with accommodation ( certificate of acceptance for service in a specialized social institution, another provider of social services with accommodation according to the form according to Appendix 4, a copy registration certificate _ _ _ of a homeless person whose form is approved Ministry of Social Policy ( for persons who are registered in such institutions or institutions);

6) information or document that confirms payment administrative fee (not submitted in case implementation registration places stay );

7) military registration document (for citizens of Ukraine, which are subject to military service _ accounting or are on military duty accounting ).

36. In case submission of the application is legal a representative ( representative ) of a person, except specified in clause 35 of this Procedure of documents, additionally served :

1) document that certifies the identity of the legal representative ( representative );

2) a document that confirms the powers of a person as a representative, except in cases when the application served legal representative minor child _

37. Statements specified in subsection 1 of paragraph 35 of this Procedure, are formed by an official of the registration body or by the administrator of the provisioning center, administrative services using _ relevant software and technical means and are reproduced copies in paper form, after what the person or legitimate representative ( representative ) confirm correctness introduced information own signature _ Responsibility for credibility information that _ contained in the statement, carries the applicant if otherwise not established by the court.

39. A person who is an acquirer of education and lives in a dormitory that belongs to the field the management of the educational institution registers own place accommodation in such a dormitory in the order specified item 35 of this Order.

40. Official of the registration body or provision center administrator administrative services check ownership of the passport document of a person to a person who it was served by him validity, correctness filling out the registration application places residence ( stay ) and availability documents required for registration _ places residence ( stay ), about which the corresponding is made entry in the application.

41. An official of the registration body for the purpose of verification belonging to the person who submitted an application for registration places residence ( stay ), appropriate housing on the right property or belonging to the owner ( co-owners ), that provided consent person for registration places residence ( stay ), appropriate housing on the right property, as well as for the purpose of verification stay of such housing in a mortgage or trustworthy property as a means of security implementation obligations uses information of the State Register real estate rights property in accordance with the Procedure for access to the State Register real estate rights property approved _ by resolution Cabinet Ministers of Ukraine dated December 25, 2015 No. 1127 "About the state registration real estate rights property and their burdens " ( Official herald of Ukraine, 2016, No. 2, Art. 108; 2018, No. 52, Art. 1827).

42. Submission of an application for registration places residents homeless and other persons who do not have permanent places accommodation depends on the appropriate specialized social institution, another provider of social accommodation services, which are provided to the specified person's social services in accordance with the Law of Ukraine "About social services ".

43. In case submission of an application for registration places residence of the homeless person in question authorized person of specialized social institution, an institution for the homeless persons, another provider social accommodation services _ or the authorized person of housing documents defined _ item 35 of this Order, at least once a week are submitted by them to the registration authority for implementation registration places residence such a person

44. In case of arrangement an orphan child, a deprived child parental care, to an institution for orphans and deprived children parental childcare _ _ at home family type, foster family place residence such child is registered at the address of the institution, nursery school at home family type, housing residence reception family _

45. Submission of an application for registration places residence or change places residence an orphan child, a deprived child parental care, relies on organs custody and care of the place residence such child _

46. An official of the registration body on the day of the person's appeal or its legal representative ( representative ) or on the day of receipt documents from the delivery center administrative services or representative specialized social institution, social institution service and social protection or data from the social welfare body protection population :

accepts decision on registration places residence ( stay ) or refusal of registration _ places residence ( stay ) of a person;

enter information about registration places residence ( stay ) to the registered territorial community in accordance with the Procedure for creation, maintenance and administration registers territorial communities, approved by resolution Cabinet Ministers of Ukraine dated February 7, 2022 No. 265;

forms registration information _ places residence ( stay ) of a person for her transmission to the department informative DMS system with subsequent transfer of information to the Unified State Demographic register in accordance with the Order of electronic informative interaction between information and communication systems and transmission by registration authorities information to the Unified State Demographic register, approved by resolution Cabinet Ministers of Ukraine dated February 7, 2022 No. 265;

at the request of a person who declares / registers / withdraws declared/registered place residence ( stay ), or its legal representative ( representative ) issues extract from the registry territorial community _

If during submission _ of documents it is established that a person who is a citizen of Ukraine, applied for registration of a new place of residence after the end of 30 calendar days after deregistration from the previous places of residence or submitted for registration places residence invalid citizen's passport of Ukraine, an official of the registration body or provision center administrator administrative services draws up a protocol on administrative matters offense in accordance with Article 197 Code of Ukraine on administrative offense _

If during submission _ documents a foreigner or a stateless person it was established that they applied for registration places residence after end of 30 calendar days from the date of receipt permanent permits _ residence, temporary residence permits residence, deregistration _ _ previous places residence or filed for registration of a new place residence invalid document, foreigner or a stateless person sent to the territorial subdivision of the Ministry of Internal Affairs according to the territory service to take action on them administrative impact or others measures defined _ legislation.

47. In case implementation registration places residence simultaneously from deregistration _ _ previous places living in another administrative and territorial units to the registration authority, on the territory service whose registered previous place person's residence, no later than the next day is sent by email form notification of deregistration _ _ places residence of the person to be entered information to the appropriate register territorial community _ In the case when the register territorial communities are created and maintained means information and communication systems of the registration and notification authority impossible send in electronic form, such notification on the day of implementation registration actions is sent to the relevant registration body in paper form _

48. On entry into the register territorial community registration information _ places residence an orphan child and a deprived child parental custody, as filed application to the registration body on the day of submission corresponding information notifies the guardianship authority _ by telephone and electronic means connection or by mail

49. Storage period application for registration places accommodation ( stay ), withdrawal from declared/registered places residence persons and, if necessary, the relevant ones copies documents which _ submitted for implementation registration places residence ( stay ) or withdrawal from declared/registered places living in a paper house form, is three years.

50. Withdrawal from declared/registered places accommodation ( stay ) is carried out on the basis of :

51. Submission of application for withdrawal from declared/registered places of residence ( stay ) of the child under 14 years of age or a person recognized by the court as limited effective or incapacitated, carried out by one of the parents or other legal representatives by agreement the other parent or legal representatives _

52. 63. 70. 73. Declaration places residence in automatic mode is carried out according to a declaration submitted by a person who has reached the age of 18 and:

74. Withdrawal from declared/registered places of residence in automatic mode is carried out in relation to a person who has reached the age of 18 and:

has a citizen's passport of Ukraine in uniform cards and/ or citizen's passport of Ukraine for going abroad, issued means The only state demographic registry ;

which assigned registration number of the account cards payer taxes _

75. Declaration with simultaneous withdrawal/withdrawal from declared/registered places accommodation is not carried out automatically in the case when at the address previous declared/registered places residence or declared/registered places residence of the person is declared/registered place residence child, legitimate representative what kind of person is that?

information about a person who is contained in the Unified State Demographic registers (if available );

information about absence at the address housing from which is carried out withdrawal from declared/registered places residence of the declared/registered applicant places residence child under the age of 14, that are contained in the department informative the DMS system.

78. 81. 2) information from the State Register of real estate rights properties does not match information specified in the documents submitted by the person or data ;

3) the person did not submit or submitted incompletely volumes of necessary documents or information ;

4) in the documents submitted by the person or information contained unreliable data or submitted documents are invalid ( except case provided for item 53 of this Procedure), or the validity period of the foreigner's passport document or stateless persons who are legal _ grounds live on the territory of Ukraine, ended ;

5) applied child under 14 years of age or a person not authorized to submit documents ;

6) housing in which the person declares or registers their own place of residence ( stay ), address not assigned in the prescribed manner;

7) at the address housing in which the person declares or registers own place residence ( stay ), available object real estate that does not belong to housing ;

8) information register territorial community of declared/registered places residence ( stay ) of parents or others legal representatives child under the age of 14 is not eligible information specified in the declaration ( application ) submitted concerning the child ;

9) data register territorial community of declared/registered places residence ( stay ) of parents or others legal representatives child by age from 14 to 18 years old do not respond information specified in the declaration ( application ) submitted a child

90. Decision on the refusal of declaration/registration/withdrawal from declared/registered places of residence accepted on the day of application by a person, a legal representative ( representative ), an authorized person of housing or authorized specialized person social institution, other provider social accommodation services, in which are provided to the specified person's social services in accordance with the Law of Ukraine "On social services ", about which the registration authority informs such persons from indication grounds for refusal means postal, telephone or electronic communication, including by means of the Diya Portal.

101. According to the results of the checks of the State Internal Revenue Service and its territorial bodies send to the registration authority the act regarding consideration of recommendations ( suggestions ) or elimination of discovered shortcomings, and violations.

1. This Order defines the principles of creation, management and administration register territorial communities, as well as the procedure of provision and transfer of information from/to such register.

2. Terms in this Order are used in the meaning given in the Laws of Ukraine "About providing public ( electronic public ) services of declaration and registration places residence in Ukraine ”, “About freedom of movement and free choice places residence in Ukraine ”, “About electronic communications ", "On protection of information in information and communication systems", "About the One state demographic register and documents that _ confirm the citizenship of Ukraine, prove identity or her special status", "On the legal status of foreigners and stateless persons " and " On refugees and persons who in need additional or temporary protection ".

3. The executive body of the village, settlement, or of the city council ( hereinafter - the registration body ) for the needs of declaration and registration places residence ( stay ) of persons, in particular for accounting persons who _ live on the territory corresponding administrative and territorial units, forms and leads in electronic form register territorial community means own information and communication systems or means a departmental informative system of LMS with access through the official website of LMS.

The registration body that maintains the registered territorial community by using its own information and communication system provides information transfer from the registered territorial community to departmental informative DMS systems with further transfer to the Unified State Demographic register every two hours for the working day, but at least once a day.

7. As a result of confirmation of compliance information and communication systems of the registration body that maintains the registered territorial community from using its own information and communication system, there is the receipt of a state document that confirms conformity software legislation in the field protection information.

8. The registration body that maintains the register territorial community software means departmental information of the DMS system, has the right to free, continuous and unhindered access to such registers.

9. 10. Registration body for establishment register territorial communities with use software means departmental informative DMS systems :

6) information about the registered place of residence internally temporarily displaced person occupied territories in Donetsk and Luhansk regions, Autonomous Republic Crimea, and the city of Sevastopol (if available );

7) phone number (if available );

electronic address mail or others means the communication (if available );

9) information about citizenship ;

10) unique record number in the Unified State Demographic Register registers (if available );

11) registration number of the account cards payer taxes from the State Register physical paying persons _ taxes or rejection notice _ from adoption registration number of the account cards payer taxes (for individuals persons who through their _ religious belief refuse from adoption registration number of the account cards payer taxes and reported it _ corresponding control body and have a stamp in the passport );

16) details of the document, based on whose was carried out declaration/registration places residence ( stay ) of a person, removal of a person from registration places accommodation ( stay ), cancellation registration actions _ Indicated information is not entered in the case declaration/registration places residence ( stay ) of a person on the basis of an application by a person who is the owner ( co-owner ) of housing, or in the case when the declaration/registration places residence ( stay ) of a person is carried out by consent owner ( co-owners ) of housing or of the authorized person for the management ( maintenance ) of the dormitory, which belongs to the field management enterprises, institutions, organizations, independently from forms ownership ( hereinafter - the authorized person of housing );

17) previous place residence from indication addresses housing ( if previous place residence ( stay ) of the person was declared/registered);

18) the date of removal of the person from declared/registered places of residence ( stay );

19) date of change declared/registered places residence ( stay ) of a person;

20) date of cancellation information about the declared/registered place residence ( stay ) of a person;

21) surname, proper name, patronymic (if available ) of the legal representative ( representative on the basic power of attorney, certified in accordance with the procedure established by law ( hereinafter - the representative ), and information on documents that confirm the authority of a person as a legal representative ( representative ), except cases when legal representatives the child is his or her parents or one of the parents ;

22) contact data of the legal representative ( representative ) (phone number, e-mail address, other mean of communication (if available );

23) information about the owner ( co-owners ) of housing ( surname, proper name, patronymic (if available ), details of the citizen's passport of Ukraine ( series and/ or number, date of issue, name authorized subject that _ issued, validity period ( if available ) and/ or details of a foreigner's passport document or stateless persons, registration number of the account cards payer taxes (if available ), information about the document that confirms ownership, phone number (if available ), email address mail (if available ), others means connection (if available ). Information in relation to each of the co-owners is filled in separately ;

24) information about the authorized person of housing ( surname, proper name, patronymic (if available ), and job title ) that provided consent to declaration/registration places residence ( stay ) of a person;

25) surname, proper name, patronymic (if available ), and job title of the person of the registration authority who provided public ( electronic public ) service of declaration and registration places residence ( stay ) and/ or made entries in the register territorial communities ;

26) information about the military account ( a separate record number in the Unified State Register conscripts, conscripts, and reservists (if available ) or information specified in the military account documents.

22. Changes to the register territorial communities, the registration body shall enter on the basis of :

1) message territorial body or of the Department of Social Security on the death of a person from indication relevant details of the passport document of the deceased person, which arrived from a state body registration Acts civil status, or a death certificate issued by a competent foreign body of the state, legalized in accordance with the established procedure;

2) death certificate of a person or information about the state registration of death from the State Register Acts civil status of citizens ;

3) message territorial body or division of the State Internal Revenue Service regarding abolition acquisition decision _ citizenship of Ukraine or termination citizenship of Ukraine ;

4) message territorial body or of the Department of Internal Affairs and Communications (in the territory service whose declared/registered place residence of a person or which done issuance of a person's passport document) on termination reasons for staying in the territory of Ukraine foreigners and stateless persons (on the expiry of the validity period or recognition invalid temporary permits _ residence, about recognition invalid permanent permits _ residence, about recognition invalid certification refugee, ID card of a person in need additional protection, identity card, which provided temporary protection );

5) message a suitable institution for the homeless persons, another provider social services from the accommodation about the loss grounds for a person to receive social benefits services that _ are provided in accordance with the Law of Ukraine "About social services ";

6) a court decision that has become a legal force, on the deprivation of the right to ownership of housing or rights of use housing, eviction, withdrawal from declared/registered places of residence ( stay ) of the person, recognition of the person is unknown absent or advertisement her deceased ;

7) termination grounds for the right to use the housing ( expiration of the contract of lease, hire, sublease housing, termination/termination study at the institution of education ), alienation housing, and other defined legislation documents ;

8) statements of the owner ( co-owners ) of housing, submitted with consideration requirements established _ Article 18 of the Law of Ukraine "On Provision public ( electronic public ) services of declaration and registration places residence in Ukraine ", the authorized person of housing, if place residence ( stay ) of the person was declared/registered, except cases registration places living in housing that _ subject to privatization ;

9) message the authorized person of the housing of the educational institution about the loss grounds for a person's residence in a dormitory, which belongs to the field management of such an educational institution ;

10) information about the state registration of death from the State Register Acts civil status of citizens.

23. In the event that the place residence ( stay ) of the person was declared/registered on the basis of a lease agreement, exclusion from the register territorial community information about the declared/registered place residence ( stay ) of the person upon application owner ( co-owners ) of housing, authorized person of housing is carried out only after expiration of the lease agreement or him premature breaking up or recognition him worthless or recognition invalid in the order specified legislation.

24. Regulations of subsection 8 paragraph 22 of this Procedure does not apply to exclusion from the register territorial community information about the declared/registered place residence ( stay ) of children, place residence ( stay ) of which declared/registered at the address places residence ( stay ) of parents or legal representatives or one of them, except declaration/registration places residence ( stay ) on the basis of a lease agreement, as well as information about the declared/registered place residence ( stay ) of the co-owner ( co-owners ) of the home.

25. In case introduction during declaration/registration/withdrawal _ from declared/registered places residence ( stay ) of false ones personal information of the registration authority obliged on the basis of submitted by a person or her legal representative ( representative ) of the faithful enter the necessary information on the day of application changes to the registry corresponding territorial communities and send information to the department informative DMS systems with further transfer of information to the Unified State Demographic register in accordance with the Order of electronic informative interaction between information and communication systems and transmission by registration authorities information to the Unified State Demographic register, approved by resolution Cabinet Ministers of Ukraine dated February 7, 2022 No. 265 ( further - Procedure for electronic interactions ).

26. In case of the adoption decision to change numbering buildings, renaming geographical objects, inhabited points, administrative and territorial units, changes in administrative and territorial arrangements are made in the manner established by law changes to the registry territorial community from preservation previous ones data on the date of registration/declaration places residence ( stay ) with a further introduction such information to the department informative system of LMS and the Unified State Demographic registry.

27. Registration authority on the day of entry information about the place residence according to the declaration ( application ) of the person or its legal representative ( representative ) to the register territorial community reports person or to its legal representative ( representative ) means postal, telephone or electronic communication, including means A single state web portal electronic services ( further - Diya portal ).

28. Access to the registered territorial community is carried out with compliance requirements Constitution of Ukraine, Laws of Ukraine "About providing public ( electronic public ) services of declaration and registration places residence in Ukraine ”, “About information ”, “About protection personal data ".

29. Officials and officials of the administrator register territorial communities, other bodies of local self-government, and bodies of state authorities that _ processed personal data entered in the registered territorial community are prohibited divulge personal data that became known in connection with the performance of official responsibilities.

30. Access to the registered territorial community is carried out exclusively authorized, with preservation information about the service or the official who made the request and the time of such request.

31. The registration authority is prohibited to transfer data from the registry territorial community to third parties for a purpose not provided for by the Laws of Ukraine "About giving public ( electronic public ) services of declaration and registration places residence in Ukraine " and "On freedom of movement and free choice places residence in Ukraine ".

32. In case detection in the registry territorial communities are false personal information of the registration authority has the right independently adjust information about such a person and informs her within thirty days from the day such information was discovered or address a person by request to provide reliable information to enter changes to the corresponding register territorial communities and transmits appropriate information to the department informative DMS systems with further transfer of information to the Unified State Demographic register in accordance with the Order of electronic interaction.

33. Data registers territorial communities are used for statistical purposes provided depersonalization of personal data that _ contained in them. Information on declaration/registration and withdrawal from declared/registered places residence persons every month by the 5th is submitted by the registration authorities to the relevant ones territorial bodies of the State Statistics Service in the form according to Annexes 1 and 2, in particular by electronic means informative interaction. 34. Each person has the right to access their own personal data entered in the registered territorial communities, as well as other rights regarding their own personal data provided _ Law of Ukraine "On protection personal data ".

35. Access to information about corrections, changes, or abolition of false data in the information entered regarding the person to the registered territorial community is provided to such person free of charge

36. At the request of the person who declares/registers place residence ( stay ), the owner ( co-owners ) of housing, legal representative ( representative ) of a person or owner ( co-owner ) of housing, authorized person of housing, mortgage holder or of trust owner ( hereinafter - the subject appeal ) registration authority or delivery center administrative services gives out an extract from register territorial communities ( further - extract ).

37. At the request of the subject appeal extract maybe to contain information about the declared/registered place residence ( stay ), removal from declared/registered places accommodation ( stay ), or cancellation _ declaration/registration places residence ( stay ) on the basic information that _ are contained in the department informative the DMS system, which arrived from bodies registration on the date of formation of such extract.

38. For the identity card of the subject appeal during a personal _ visiting the registration authority appears passport document of a person or certificate of application for protection in Ukraine. 39. Extract in the paper room form appears an employee of the registration body or delivery center administrative services person or to her legal representative ( representative ), who submitted the passport document and the document that confirms the ownership of housing (in case application for an extract the owner housing ), the authority of a legal representative ( representative ), after checks their propriety and validity.

40. Extract is formed at the request of the registration authority or delivery center administrative services means departmental informative of the DMS system and is confirmed electronic qualified with the DMS seal, which is displayed in the extract during his _ formation and reproduced in paper form _

41. Extract contains information about the surname, actually name, patronymic (if available ), date of birth, unique registration number in the Unified State Demographic Register register (if available ), registration number of the account cards payer of taxes (if available ), address and date of declaration/registration places residence ( stay ) or address and date of removal places residence ( stay ), or information about the cancellation place residence ( stay ), type of extract, date of formation extract, extract number, name of the registration body, basis for formation extract, date of the request for an extract, information about the subject request _

electronic informative interaction between information and communication systems and transmission by registration authorities information to the Unified State Demographic register

1. This Order defines transfer mechanism and terms information on declaration/registration places accommodation ( stay ), withdrawal from declared/registered places residence ( stay ) ( further - registration action ), cancellation registration actions executive bodies rural, settlement or of the city council ( further - the registration body ), which carry out declaration/registration, withdrawal from declared/registered places accommodation ( stay ), cancellation registration actions physical persons on the territory corresponding administrative and territorial units to which they apply powers rural, settlement or of the city council, for introducing her to the department informative DMS systems, in particular means the only one informative system of the Ministry of Internal Affairs, and further transfers corresponding information to the Unified State Demographic register ( further - Register ).

2. Information from the registry territorial community is transferred to the department informative DMS system on the day of execution registration actions each two hours for the working day, but at least once a day:

automatically - in case driving register territorial community software means departmental informative DMS systems with access through the official DMS website;

from application systems, electronic interaction states electronic information resources through a single information system of the Ministry of Internal Affairs - in case driving register territorial community means own information and communication systems.

3. Registration of the action is complete after receipt by the registration authority confirmation from the departmental informative system of DMS on making information on declaration/registration or withdrawal from declared/registered places of residence ( stay ) or abolition of such registration actions to the department informative DMS system.

4. Information from the department informative of the DMS system, the DMS is entered into the Register :

relation to the person whose information is entered in the Register ;

during registration _ documents that _ confirm the citizenship of Ukraine, prove identity or her special status, - in case enter into the Register information about the person for the first time.

After income information from the registry territorial community registration information _ action or cancellation _ registration actions stored in the department informative to the DMS system and is transferred to the Register through automatic formation sets data.

5. To perform the tasks assigned to the LMS, in particular of software driving Register, territorial the authorities of the State Internal Revenue Service send requests to registers territorial communities regarding verification and clarification information about the place residence ( stay ) of individuals persons _

For the purpose of verification, clarification, and/ or introduction information about the place of residence ( stay ) of the requested person is responsible an employee of the registration authority conducts the appropriate checks for all available accounts ( in particular paper ) and/ or in case of absence relevant information uses measures to find out the requested information. According to the results of such checks, an employee of the registration body measures are being taken before introduction or actualization location data _ residence ( stay ) of a person in the register corresponding territorial community with subsequent transfer to the department informative system of DMS and Register.

Workers' bodies registration carries responsibility for the timeliness, reliability, and completeness of introduction and/ or adjustment of location data _ residence ( stay ) of a person in the registered territorial communities and their subsequent transfer to the department informative system of DMS and Register.

The term of consideration of such requests and providing answers to them should not exceed three workers' days from their day receiving _

6. To perform tasks assigned to bodies _ registration, authorities registration have the right to access others' information and communication systems of bodies state authorities and bodies local self-government.

7. Organs state authorities, bodies local self-government within its borders powers they can get information about the registered/declared place residence ( stay ), that contained in the Register and departmental informative the DMS system. Granting such information is carried out exclusively in the cases stipulated by the laws of Ukraine, and only in the interests of national security, economic welfare, and protection of human rights or by consent of the person himself. Information about the declared/registered place of residence ( stay ) is transferred by the introduction of electronic informative interaction means systems electronic interaction state electronic information resources.

8. Informational interaction happens by using means systems electronic interaction state electronic information resources.

In case of absence of technical opportunities of transfers data from using channels connection systems electronic interaction state electronic informative resources informative interaction subjects, informative relations maybe occur from using others information and communication systems with using their respective ones complex protection systems information with confirmed conformity according to the results of the state examinations in the established order legislation.

Exchange of information is carried out electronically from with compliance requirements laws of Ukraine "About electronic trustworthy services ", "About protection personal data ”, “About protection of information in information and communication systems".

Information sent by the Action Portal is included in the Unified State Register of conscripts, conscripts, and reservists. Information is assigned a separate entry number in such a register.

Interaction of the Action Portal with the One state register conscripts, conscripts, and reservists carried out through Edina the information system of the Ministry of Internal Affairs until the moment of implementation of electronic informative interaction through the electronic system interaction state electronic information resources.

15 ^{- 3}. Information on declaration/withdrawal from declared/registered places residence conscripts, conscripts, and reservists, sent by the registration authority through the United information system of the Ministry of Internal Affairs to the Unified State Register conscripts, conscripts, and reservists, is the basis for taking a person into the military accounting or removal from the military accounting appropriate territorial center of recruitment and social support _
