Responsibility for violating migration legislation
A citizen of another state who comes to Ukraine to study or look for work as a tourist, businessman or preacher, and violates the conditions of staying on Ukrainian soil, is liable. Furthermore, a penalty (fine) is imposed for staying on our territory after the certificate’s expiration, an administrative violation.
In addition, foreign offenders can be returned to their country of origin or deported from Ukraine.
- Forced return awaits foreigners whose actions violate the law or public order or threaten national security. The decision on forced return entails another restriction: a person will not have the right to enter Ukraine for three years.
- Forced expulsion is applied to violators of sanctions already applied to them: they refuse to comply with the decision to return. In this case, the punishment is more severe, and the ban on entering Ukraine is longer than років5 years.
Administrative liability is provided by law for illegal crossing the state border or even attempting to cross it. A foreign violator who tried to cross the border without the authorities’ permission and relevant documents must pay a fine of 100 to 200 tax-free minimum incomes or be arrested for up to 15 days.
If there were several violators or a group of persons, the law provides a fine of 200 to 500 tax-free minimums.
